Wills, Trusts and Estate Lawyers

New York Attorneys for the Drafting and Administration of Trusts

With a perspective garnered from decades of experience representing individuals and business owners, Einbinder & Dunn provides counsel in the areas of trusts, estates and estate planning to a wide range of individuals and families. Because each client operates under his or her own particular set of circumstances, the concept of Unique Perspective, Experienced Approach® always applies.

At our New York law firm, we draft, review, amend and administer testamentary trusts, as well as revocable and irrevocable living trusts (also called inter vivos trusts). We prepare both simple and complex trusts, including life insurance trusts and qualified personal residence trusts. These effective estate planning tools can be leveraged to achieve multiple objectives. They can replace or supplement wills, helping you manage property during life while ensuring a smooth transition of affairs after death.

Living Trusts and Trust Administration

In a living or inter-vivos trust, the assets held in the trust are legally run, managed and controlled by the trustee. The trustee is a fiduciary — a person who occupies a position of trust and confidence. A fiduciary is subject to strict responsibilities called fiduciary duties. These higher standards of performance govern trust administration.

The trustee holds the trust property solely for the benefit of the beneficiaries of the trust. We assist you in crafting a document that expresses and effectuates your desires. These beneficiaries may be individuals, but they may also be charitable organizations that receive the income and principal on or after the trustor's death.
